Terms of Service

Swapsona ("we", "us") is an online photo service at swapsona.com, run as a sole proprietorship in Oregon, USA. These terms are an agreement between you and us. By creating an account or buying credits you agree to them. If you don't agree, please don't use Swapsona.
1. Who can use Swapsona
- You must be at least 18 years old.
- One account per person. The details you give us must be accurate, and you're responsible for keeping your password private and for everything done with your account.
2. Your photos
- Only photos you're allowed to use. Upload only photos of yourself, or of someone who has clearly agreed to have their photo edited this way. In a group photo, only the person you mark is changed; everyone else must still be someone who wouldn't object to the photo being used.
- Never anyone under 18. The person being edited must be an adult. Don't upload photos of children.
- No nudity or sexual content. Don't upload nude, sexual, or sexually suggestive photos, and don't use Swapsona to make any.
- You keep ownership. Your photos and results stay yours. You give us a limited permission to store, process, and display them only to run the service for you, keep your account history, review flagged content, and meet legal obligations.
- We don't sell or train on your photos. We don't sell your photos or results, and we don't use them as training data for any software.
- Deleting. You can delete any photo or result, or your whole account, from your profile. Deleted files are removed from our live systems right away and from backups as those backups expire.
3. Reviews and safety checks
Every upload and result goes through automatic safety checks for nudity and for people who may be under 18. We also measure a few proportions of the face in your photo and in each result, to check the result still looks like you; how we handle those measurements is in our Privacy Policy, and you agree to it when you sign up. Automatic checks make mistakes, so a flagged photo is held for a person to review rather than rejected on the spot. While a photo is in review its run waits; you can cancel it and get your credits back. If a review finds that a photo breaks these terms, we remove it, return any credits held for it, and may close the account. Photos that appear to show a minor in a sexual way are blocked and deleted without anyone viewing them, and we report illegal content to the authorities where the law requires it.
4. Things you may not do
- Harass, bully, shame, out, or misgender anyone, or make results meant to humiliate someone.
- Pass a result off as a real, unedited photo in a way meant to deceive (for example for identity checks, dating fraud, or impersonating someone).
- Use Swapsona for anything illegal, hateful, or sexual.
- Overload, scrape, probe, or attack the service, get around its limits or checks, or use automated tools without our written permission.
- Resell the service or share an account.
We may refuse, remove, or stop processing any content, and suspend or close accounts, when these terms are broken.
5. Results
- Results are computer-made edits of your photo. They show one way you might look. They aren't a prediction, and they won't always be accurate or flattering.
- Variance settings control how strictly our automatic measurement compares the face in your result with the face in your photo. They're a target and can't be guaranteed. Results that miss the variance you asked for are still saved in your account under "below requested variance".
- Time estimates and queue positions are estimates.
- You may use your results for any lawful purpose, subject to these terms and to the rights of anyone else in the photo.
6. Credits
- What credits are. Credits are prepaid units that pay for runs on Swapsona, and nothing else. They have no cash value, can't be exchanged for money, and can't be sold, transferred, gifted, or used anywhere else. They belong to the account that bought them.
- What a run costs. The number of credits a run uses depends on the speed and variance you choose, and is shown before you confirm the run. Prices for credit packs are shown before you pay.
- When credits are used. Credits are taken only when a run delivers a result, and when you've chosen a variance, only a result within it. If none of the attempts we make meets it, the credits are returned to your account. Runs on photos that our checks can't measure cost nothing.
- If an edit goes wrong. Use Report a problem on the picture's page. We look at every report, and if the edit went wrong, the credits that run used go back to your account.
- No expiry. Credits don't expire while your account is open.
- Refunds. You can get a refund of a credit pack within 14 days of buying it, as long as you haven't used any credits from that pack. Apart from that, credit purchases are final, except where the law gives you a right to a refund. Refunds go back to the original payment method. When a pack is refunded (by us or through your bank), its credits are taken back; if some were already used, new runs wait until that's settled.
- If we shut down. If we close Swapsona for good, we'll refund the paid credits left in your account to your original payment method.
- Closing your account. If you close your account, unused credits are lost unless they qualify for a refund above. If we close your account for breaking these terms, unused credits are lost.
- Disputes. If you dispute a payment with your bank, we may pause your account while it's sorted out. Please contact us first; we can usually fix problems faster.
- Free credits. Promotional or bonus credits have no value, can't be refunded, and may be withdrawn.
7. Gifts ("help fund my transition")
A gift through "help fund my transition" is voluntary and supports the person who makes Swapsona. You get nothing in exchange for a gift. It doesn't affect your account or your runs, and it isn't tax-deductible. Gifts can't be refunded, except for mistakes you tell us about within 14 days.
8. Payments
Payments are handled by Stripe. We never see or store your card details. Prices are in US dollars and include any taxes we're required to charge; your bank may add its own fees for a payment in another currency. We may limit sales to some countries.
9. The service
Swapsona runs on our own equipment. It may slow down, queue, or be paused for maintenance, and we can change or stop features. We don't promise it will always be available or error-free.
10. Our rights
The website, its software, design, and the descriptions of looks it uses belong to us. These terms don't give you any rights to them beyond using Swapsona as offered.
11. Disclaimers
Swapsona is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including that results will be accurate, fit a particular purpose, or meet your expectations.
12. Limits on liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim about Swapsona is limited to the amount you paid us in the 12 months before the claim.
13. Your responsibility
You agree to cover our reasonable losses and costs if someone makes a claim against us because of content you uploaded or the way you used Swapsona in breach of these terms.
14. Law and disputes
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Oregon, except that either of us may bring a claim in small claims court where it qualifies. Nothing here takes away rights you have under the consumer laws of the place you live.
15. Changes
We may update these terms. If a change matters, we'll tell you by email or on the site before it takes effect. Using Swapsona after that means you accept the new terms.
